The promoter is the Jim Clark Trust registered charity SC046092, 13 Whitsomehill, Duns, Berwickshire UK TD11 3NF (“JCT”).
By entering in to the competition persons agree to be bound by these Terms and Conditions.
JCT reserves the right to update the terms and conditions during the course of the prize competition.
The competition will run from 07:00 on 12 Jul 2018 (the “Opening Date”) to the announcement of the winner at the opening of the new Jim Clark Museum at a date to be confirmed by JCT and in any event before 17:00 on 31 Dec 2019 (the “Closing Date”) inclusive.
All competition entries must be received by JCT by no later than 17:00 on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.
Each entry must be accompanied by an entry fee of £20. Entries are required to provide name, address, email address and telephone number. It is the responsibility of entrants to ensure that personal information provided is accurate.
JCT will not accept: 1) Responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause or 2) proof of posting or transmission as proof of receipt of entry to the competition.
The competition is open anyone aged 18 years and over, except: 1) Trustees and employees of JCT; or 2) employees of agents or suppliers of JCT who are professionally connected with the competition or its administration; or 3) members of the immediate families or households of (1) and (2) above.
There is no restriction on the number of entries per person.
In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize.
JCT reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.
The prize is a Jim Clark Special Edition Lotus Evora GT410 Sport. JCT reserves the right to substitute the prize with a prize of equal or greater value. The winner will be responsible for collecting the car as seen from JCT and for all insurance, transportation, maintenance and running costs from the time of collection.
In the event of more than one correct entry, a winner will be drawn randomly from all correct entries.
The winner of the prize competition will be announced at the opening of the new Jim Clark Museum at a date to be confirmed by JCT (and in any event before 31 December 2019) (the “Announcement Date”).
JCT will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 30 of days of the Announcement Date, JCT reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.
JCT will send the name of the winner to anyone who writes within one month after the Closing Date of the competition requesting details of the winner.
In the event the winner does not wish to keep the prize car or wants to sell the car within a period of one year, JCT will have first option and (if not purchased by JCT) Leven Car Company shall have the second option to purchase the car at a reasonable price determined by the purchaser taking in to consideration the condition and mileage of the car.
Personal data from competition entries will be kept private and will not be shared with any third parties without prior permission. Entries agree data can be used for future JCT marketing purposes unless specified otherwise. The name and image of the winner will be used by JCT for marketing and publicity purposes.
Any disputes in respect of the competition or these Terms and Conditions will be decided by JCT acting reasonably. JCT’s decisions made pursuant to the Terms and Conditions shall be final and binding.
JCT may suspend the prize competition for any period of time where it becomes necessary to do so. During such period JCT shall retain any amounts which were paid prior to such suspension taking effect.
JCT shall not be liable for any loss or damage arising from entries.
These terms and conditions shall be governed by Scottish law and the parties submit to the non-exclusive jurisdiction of the courts of Scotland.
